Experienced Motorcycle Accident Lawyers

Protecting Your Right To A Fair Recovery

At Miller Kory Rowe, we understand just how tragic motorcycle accidents can be, both for victims and their families. Our legal team provides compassionate legal representation to injured bikers and the families of fatal motorcycle accident victims throughout Arizona. We fight for those who have suffered catastrophic injuries and life-altering losses, making it our mission to hold negligent parties accountable and ensure that justice is served.

Riders Representing Riders

Lots of firms say they understand motorcycle cases. At MKR, the attorneys handling them actually ride.

That matters more than it sounds. A rider knows why you picked that lane position, how a bike reacts under hard braking, and what gear can and can’t do in a crash. When an insurer’s version of events doesn’t add up, a rider-attorney knows what to look for.

Why Motorcycle Accident Cases Are Different

A motorcycle claim isn’t just a car accident claim with fewer wheels. Three things set it apart, and each one changes how your case should be handled.

Riders Face Bias From Insurers and Juries

Many people assume a rider must have been speeding, weaving or showing off.

Insurance adjusters know this, and some use it to shift blame onto you or lowball your claim.

As a motorcycle injury lawyer in Phoenix, MKR counters that bias with evidence.

That can mean crash reconstruction, video from nearby businesses, phone records, and witness statements that show what the other driver did.

The attorneys also know how to talk to jurors about riders in a way that cuts through the stereotypes.

The Injuries Are Usually Serious

A rider has no seat belt, no airbag and no steel frame. Even a low-speed crash can mean broken bones, road rash, spinal injuries or a brain injury.

Those injuries often need months of treatment, and some change a person’s life for good. Your claim has to account for the costs that come later, not just the bills you have today.

The Insurance Often Isn’t Enough

Many drivers carry only the minimum coverage Arizona requires.

When a rider is badly hurt, that policy can run out quickly. Knowing where else to look is a big part of what an experienced motorcycle crash lawyer does.

How MKR Helps Injured Riders

mkr personal injury attorneys

Every time you ride, you trust other drivers to look out for you.

When one of them fails you, you need a legal team you can count on.

That’s why Miller Kory Rowe brings together attorneys with backgrounds in riding, trial work and serious injury cases to fight for justice.

Every case is prepared as if it will go to trial. You’ll get personal attention and regular updates, and the legal details are handled so you can focus on healing.

Finding Every Source of Coverage After a Phoenix Motorcycle Crash

Arizona’s minimum bodily injury coverage under A.R.S. § 28-4009 is $25,000 per person and $50,000 per accident.

For a rider who needs surgery, a long hospital stay or time off work, that money can run out before treatment is finished.

That’s why MKR looks past the at-fault driver’s policy from day one. Possible sources of recovery include:

  • The at-fault driver’s liability policy. This is usually the first place to look.
  • Your own UM/UIM coverage. Uninsured and underinsured motorist coverage on your own policy can pay when the other driver has no insurance or not enough.
  • An employer’s policy. If the driver was working at the time of the crash, the employer’s coverage may apply.
  • Other liable parties. A government agency responsible for a dangerous road, or a manufacturer of a defective part, may share responsibility.

Under A.R.S. § 20-259.01, Arizona insurers have to offer UM and UIM coverage when they sell a motor vehicle policy.

If you’re not sure what’s on your policy, bring it to your consultation and the team will go through it with you.

Common Causes of Motorcycle Accidents in Phoenix

Riders take on far more risk than people in cars.

According to the National Highway Traffic Safety Administration, motorcyclists were almost 27 times more likely than passenger car occupants to die in a crash and almost 5 times more likely to be injured.

Arizona sees that risk up close. The Arizona Department of Transportation’s 2024 Crash Facts report counted 219 motorcyclist deaths in the state that year.

Most of these crashes come down to a driver’s mistake. Here’s what tends to cause them in and around Phoenix.

Left Turns on Wide City Streets

Phoenix is built on a grid of wide, multi-lane streets. A driver turning left across several lanes can easily misjudge how fast an oncoming bike is moving, or fail to see it at all.

Freeway Merges and Blind Spots

On I-10, I-17, the Loop 101 and the Loop 202, traffic moves fast and changes lanes often. A driver who doesn’t check a blind spot can push a rider off the road in a second.

Distracted, Impaired and Aggressive Drivers

  • Texting or using a phone while driving
  • Driving under the influence of alcohol or drugs
  • Speeding, tailgating and road rage
  • Running red lights or failing to yield

Sun Glare, Monsoon Storms and Road Hazards

Low morning and evening sun on east-west streets can blind drivers.

During monsoon season, dust storms cut visibility and the first rain can leave roads slick. Potholes, loose gravel, debris and poorly marked work zones are dangerous for anyone on two wheels.

Confusion About Lane Filtering

Since 2022, Arizona has allowed riders to pass stopped vehicles between lanes in limited situations under A.R.S. § 28-903.

Some drivers still don’t expect a bike between lanes, and a sudden lane change or opened door can cause a crash.

Who Is Responsible for a Motorcycle Accident?

Figuring out who caused the crash also tells you who has to pay for your losses.

Arizona is a fault-based state, so the person or company that caused the crash is responsible for the damage it did.

Usually that’s another driver. But other parties can share the blame, such as a city or county that didn’t fix a dangerous road, a company whose employee was driving for work, or a manufacturer of defective parts.

If a driver hits you in a car or truck, MKR’s Phoenix car accident attorneys deal with these same insurers every day.

What if the insurer says you were partly at fault? Arizona follows pure comparative fault under A.R.S. § 12-2505, so your compensation is reduced by your share of fault but not wiped out. A Phoenix motorcycle injury lawyer can push back on that with evidence.

Compensation for Motorcycle Accident Victims

Helmets and good gear lower the risk of serious injury, but they can’t remove it. Many riders end up with injuries that affect their health, work and family for years.

Those losses are called “damages.” By filing a motorcycle accident claim in Arizona, you can seek money for them. Depending on your case, that may include:

Financial losses

  • Medical expenses, including emergency care, hospital stays, surgery and prescriptions
  • Future medical care, rehabilitation and physical therapy
  • Lost wages and employment benefits
  • Lost earning capacity if a permanent injury limits future work

Personal losses

  • Physical and mental pain and suffering, now and in the future
  • Lost enjoyment of life
  • Disfigurement and scarring
  • Emotional distress and anguish

When a crash takes a rider’s life, the family may also recover funeral and burial costs through a Phoenix wrongful death claim.

The Arizona Constitution (Article 2, Section 31) doesn’t allow limits on the amount you can recover for injury or death. Still, every case is different, and the value of yours depends on the facts. The team can walk you through your options in a free, no-obligation consultation.

Frequently Asked Questions About Arizona Motorcycle ACCIDENTS

Call 911 and report the accident right away. Seek medical attention, even if you think your injuries are minor. Collect the other driver’s information, take photos of the scene, and gather witness contacts. Avoid admitting fault or making statements to insurance companies before speaking with an attorney.

Liability depends on the cause of the crash. Responsible parties may include negligent drivers, vehicle manufacturers, government entities responsible for unsafe road conditions, or even construction contractors who failed to provide proper warnings. An attorney will investigate every potential source of liability.

In most cases, you have two years from the date of the accident to file a personal injury lawsuit. If your claim involves a government vehicle or unsafe roadway, you must file a notice of claim within 180 days. Missing these deadlines can prevent you from recovering damages.

Yes. Arizona law allows injured riders to recover damages even if they weren’t wearing certain safety gear, such as a helmet. However, the defense may argue your injuries were more severe because of that choice, potentially reducing compensation. An experienced attorney can help counter these arguments.

A motorcycle accident attorney can investigate the crash, collect evidence, work with accident reconstruction experts, handle insurance negotiations, and represent you in court if necessary. At Miller Kory Rowe, our team uses decades of trial experience to hold negligent drivers accountable and secure justice for injured riders across Arizona.
